CapFive Posted April 23, 2012 Posted April 23, 2012 so i am getting addicted to mashupsand im wondering, if i submitted a mashup to a radio station, would i be able to get it played? i mean im not looking to get any money or fame, just would love to hear something i put together playing on le radio (public not private lol)so does anyone know if its legal? or would i need to get artists permission? Quote
Mitch Posted April 23, 2012 Posted April 23, 2012 artists permission would be needed due to copyright on both the vocal and the song you are using Quote
OxyKon Posted April 23, 2012 Posted April 23, 2012 Assuming you would have to get le artists permission yeah, cause your essentially using parts of their track and remixing it for your needs, but of your not gonna get paid for it then I wouldn't think there would be a problem, but that's just me Quote
CapFive Posted April 23, 2012 Author Posted April 23, 2012 cool so now i just need to be able to get in contact with some of the biggest celebs in the world.... Quote
CapFive Posted April 23, 2012 Author Posted April 23, 2012 guess i could maybe just try and stay local, maybe some aussie artists could be open to the idea Quote
Duz Posted April 23, 2012 Posted April 23, 2012 90% of artists music isn't owned by them, meaning you don't have to ask them, you have to ask the owners. When a track is signed to a label, it is the property of the label to do with what they want. For your purposes, this works in your favour, because most big labels have H&R departments that deal with this sort of thing daily. But it all comes down to the track and what publishing rights are in place for each tune. It's a WHALE of a thing to deal with, and if you were signed you can usually just ask your label rep to get clearances for you.. Quote
CapFive Posted April 23, 2012 Author Posted April 23, 2012 lol hey maybe i can start a new thing, im a mashup artist Quote
AlexJ Posted April 23, 2012 Posted April 23, 2012 what about parodys? can't he just 'insert funny quote here mid song' and call it a parody? Saying he was just ripping someone off because it was funny, not that it has to be offensive or anything. but i hear parodys played all the time on the radio. Quote
GREMM1S Posted April 23, 2012 Posted April 23, 2012 No labels will almost always say no for the use of mashup, you need more indie/unsigned artists who have the control over the files. Its stupid because they are essentially losing out on exposure in different segments of listens but ah well. Quote
Jaz Posted April 23, 2012 Posted April 23, 2012 yes, sea FM plays mash-ups all the time, last mash-up i heard them play was ART VAN DELAY's "Levels Vs Somebody i used to know" Quote
GREMM1S Posted April 23, 2012 Posted April 23, 2012 Anna lunoe and bagraiders were the first to do that bootleg haha, i guess thats the problem with them no ownership Quote
SolDios Posted April 23, 2012 Posted April 23, 2012 some of the fresh fm hosts seem to play there own bootlegs all the time.So im not sure what to say Quote
legunner Posted April 23, 2012 Posted April 23, 2012 It's a tricky one because you can use the fair use argument but who knows. Quote
Jaz Posted April 24, 2012 Posted April 24, 2012 Anna lunoe and bagraiders were the first to do that bootleg haha, i guess thats the problem with them no ownershipapparently these guys released it long before bag raiders did Quote
GREMM1S Posted April 24, 2012 Posted April 24, 2012 Just because those stations are playing doesnt mean they have the ok from the labels which i would doubt they have. I noticed when i used to hear them on the edge they called them remixes. Quote
Tomy Posted April 25, 2012 Posted April 25, 2012 you don't have to ask permission from artist or label at all. As soon as the station decides to play it, its then their responsibility. when i had my radio show i played mashups all the time. What i did was ensure that all tracks used in the mashup were included on my submission sheet to APRA. This sheet was all the tracks i played during the show on air then submitted to APRA so they can delegate royalties correctly. the only issue would be a re-recording of copyrighted material which comes under AMCOS stuff. But i would say its highly highly HIGHLY unlikely for a copyright owner is going to hunt you down for that. in saying all that the radio station should have all correct license's so let them handle it. if its an online station no registered with APRA etc. i still dont think it would be an issue. radio play is fine, zippy share is a WHALE. labels of any kind would love support and radio play. Funkymixes did a ton of vinyl release mashups iirc, could be worth looking into the history of those? Quote
Tomy Posted April 26, 2012 Posted April 26, 2012 hmmm maybe i wasn't clear enough. example of how i used to do itON AIR: "That was... 50 cent vs justin beiber - in da baby (CAP 5 SUPER ULTRA MASHUP)" ON APRA FORM MUSIC I'VE PLAYED ON THE SHOW1. 50 Cent - In da Club2. Justin Beiber - Baby Quote
